Terms and Conditions

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY.
By accessing or using the Dream College Planner website, mobile application, and related services (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the Service.
These Terms are a legal agreement between you and Dream College Path LLC ("Dream College Path," "we," "us," or "our"). If you are using the Service on behalf of a school, organization, or other entity, you represent that you are authorized to accept these Terms on that entity's behalf.
IMPORTANT NOTICE REGARDING DISPUTE RESOLUTION. These Terms contain a dispute resolution and arbitration provision and a class action waiver in Section 18. Please read it carefully because it affects your legal rights.
1. Definitions
For purposes of these Terms:
- "Account" means the user account you create to access the Service.
- "Student" means an individual using the Service for middle school or high school planning.
- "Parent/Guardian" means a parent or legal guardian of a Student who is a minor.
- "Content" means text, software, code, audio, video, images, worksheets, templates, course materials, and other content made available by Dream College Path through the Service.
- "User Content" means information and materials you submit or make available through the Service, including transcripts, grades, essays, application status, schedules, messages, and other data.
- "Paid Services" means any subscription, package, or paid session (e.g., tutoring, counseling, mentoring) offered through or in connection with the Service.
2. Eligibility; Accounts for Minors
The Service is intended for Students, Parents/Guardians, and other authorized users (e.g., counselors) who are permitted to use the Service under applicable law.
2.1 Age Requirements
The Service is not directed to children under 13. If you are under 13, you may not use the Service unless a Parent/Guardian provides verifiable consent and we enable access for your Account. If you are 13 or older but under the age of majority where you live, you may use the Service only with the involvement and consent of your Parent/Guardian.
2.2 Parent/Guardian Consent and Responsibility
If you are a Parent/Guardian and you permit a minor Student to use the Service, you agree to these Terms on behalf of yourself and the Student, and you are responsible for the Student's use of the Service, including any activity under the Student's Account.
2.3 Account Registration and Security
You agree to provide accurate information when creating an Account and to keep your Account information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your Account. You must notify us promptly if you suspect unauthorized access or use.
3. The Service
Dream College Planner is a digital planning and support platform that may include features such as:
- Academic planning (courses, grades, goals, and activities tracking)
- Transcript and document upload and storage
- College and scholarship exploration and application tracking
- Scheduling and management of tutoring/counselor/mentor sessions
- Messaging and collaboration tools (as available)
- AI-assisted tools that may provide suggestions, summaries, or planning support
We may add, remove, or modify features at any time. Certain features may be available only in specific plans or geographies.
3.1 Educational and Advisory Nature; No Guarantee
The Service provides educational information and planning support only. Admissions, financial aid, scholarships, and related decisions are made by third parties (schools, testing organizations, scholarship providers, etc.). We do not guarantee admission to any institution, any scholarship outcome, any score improvement, or any specific result.
3.2 Not a School; Not Professional Advice
Dream College Path is not a school, college, university, or testing agency. Content on the Service may include general information about admissions, testing, and financial aid; it is not legal, tax, medical, or professional advice. You should consult qualified professionals for advice tailored to your situation.
3.3 AI Features and Limitations
If the Service provides AI-generated or AI-assisted outputs, those outputs are generated based on the information available and may be incomplete, outdated, biased, or incorrect. You are responsible for verifying outputs and making decisions based on your own judgment and independent sources. AI outputs are not a substitute for guidance from qualified counselors, educators, or professionals.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms.
4.1 Prohibited Conduct
You agree that you will not:
- Use the Service for any unlawful, harmful, abusive, harassing, defamatory, obscene, or discriminatory purpose
- Attempt to gain unauthorized access to the Service, other users' Accounts, or our systems
- Scrape, crawl, harvest, or use automated means to access the Service except as expressly permitted
- Reverse engineer, decompile, or attempt to extract source code, underlying models, or algorithms (except to the extent permitted by law)
- Upload malware, viruses, or malicious code, or interfere with the integrity or performance of the Service
- Impersonate another person, misrepresent your identity, or create a false Account
- Use the Service to violate the intellectual property or privacy rights of others
4.2 Academic Integrity and Authenticity
You are responsible for ensuring that your college applications and related submissions are authentic and comply with the policies of the relevant institutions. Unless explicitly stated otherwise, our counselors, tutors, and tools are intended to support and coach Students; they are not intended to write, fabricate, or misrepresent application materials on a Student's behalf.
5. User Content
The Service may allow you to submit, upload, store, share, or otherwise make available User Content.
5.1 Ownership and License
You retain ownership of your User Content. However, in order to operate the Service, you grant Dream College Path and its service providers a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, display, and process your User Content to provide, maintain, secure, and improve the Service and to perform our obligations and exercise our rights under these Terms.
If you share User Content with others through the Service (for example, with a Parent/Guardian, counselor, tutor, or mentor), you acknowledge that those recipients may access and use that User Content consistent with the sharing settings you choose.
5.2 Your Responsibilities for User Content
You represent and warrant that:
- You have all rights, permissions, and consents necessary to submit the User Content (including any education records you upload, such as transcripts).
- Your User Content is accurate to the best of your knowledge and does not violate any law or the rights of any third party.
- You will not upload sensitive personal information that is not reasonably necessary for college planning (e.g., Social Security numbers, banking credentials) unless we specifically request it for a legitimate purpose and provide a secure method.
5.3 Monitoring and Removal
We may (but are not required to) review User Content and may remove or restrict access to User Content that we believe violates these Terms, is unlawful, or may expose us or others to risk. We may also suspend or terminate Accounts as described in Section 16.
5.4 Feedback
If you provide suggestions, ideas, or feedback about the Service ("Feedback"), you agree that we may use the Feedback without restriction or compensation to you.
6. Intellectual Property and License to Use the Service
6.1 Our Intellectual Property
The Service, Content, and all related technology, designs, interfaces, trademarks, and materials are owned by Dream College Path or its licensors and are protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, or create derivative works from the Service or Content.
6.2 Limited License to You
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial educational use (or, if you are a school or organization, for your internal educational use as agreed in writing).
6.3 Restrictions
You may not share paid or proprietary materials with non-authorized users, resell access, or allow others to use your Account except as expressly permitted (for example, allowing a Parent/Guardian access to a Student Account where enabled).
7. Third-Party Services and Links
The Service may integrate with or link to third-party services (e.g., video conferencing, calendar, messaging, payment processors, learning tools). We do not control and are not responsible for third-party services, and your use of those services is subject to their separate terms and privacy policies. We may share information with third parties as needed to provide the Service (for example, to process payments or deliver sessions), as described in our Privacy Policy.
8. Paid Services, Billing, and Refunds
Some parts of the Service may be offered for a fee, including subscriptions and packages for tutoring, counseling, mentoring, essay review, or other services. Additional terms may apply to certain Paid Services and will be provided at purchase, in an order form, or in a service agreement. If those additional terms conflict with these Terms, the additional terms will control for the specific Paid Service.
8.1 Pricing and Taxes
Prices, features, and availability of Paid Services may change at any time. You are responsible for any applicable taxes, unless we state otherwise.
8.2 Authorization and Payment
By purchasing Paid Services, you authorize us (and our payment processor) to charge the payment method you provide for the applicable fees, including recurring fees if you enroll in an auto-renewing subscription.
8.3 Auto-Renewal and Cancellation
If you purchase a subscription, it may renew automatically at the end of each billing period unless you cancel before renewal. You may cancel through your account settings, the applicable app store account settings (for in-app purchases), or by contacting us. Cancellation stops future charges, but does not automatically entitle you to a refund for amounts already paid, except as required by law or expressly stated at purchase.
8.4 Refunds and Trials
Refund eligibility (if any), trial periods, and other promotional terms (if offered) will be disclosed at sign-up or purchase and may vary by plan and channel. Unless required by law or expressly stated otherwise, fees are non-refundable and unused time, credits, or session hours may expire. For services delivered in part (e.g., counseling or tutoring hours already used), the used portion is not refundable.
8.5 Session Scheduling, Rescheduling, and No-Shows
Paid sessions may be scheduled subject to availability. Unless otherwise stated at booking:
- You may reschedule or cancel a confirmed session without penalty if you do so at least 24 hours before the session start time.
- Cancellations or reschedules with less than 24 hours' notice, or failure to attend, may result in a forfeited session or a no-show charge/credit deduction.
- If your counselor/tutor must cancel or reschedule, we will work with you to reschedule or (if appropriate) credit the impacted session.
8.6 One Student per Student Account
Unless we explicitly authorize otherwise, a Student Account and any associated paid learning materials or sessions are intended for use by a single Student. We may suspend or terminate access if we reasonably believe an Account is being shared or used by multiple students.
9. Communications
By creating an Account and providing contact information, you consent to receive communications from us about the Service, including notices, administrative messages, and updates. Communications may include email, in-app notifications, phone calls, or text messages, and may use automated technology where permitted by law. Standard messaging and data rates may apply. You can manage certain preferences in your Account settings, and you may opt out of promotional messages as described in the messages.
10. Privacy
Our Privacy Policy explains how we collect, use, and share information, including Student information and education-related data. The Privacy Policy is incorporated by reference into these Terms. If you do not agree with the Privacy Policy, you should not use the Service.
11. Copyright and Intellectual Property Complaints
If you believe that content on the Service infringes your copyright, you may notify us by sending a written notice to: DMCA Agent, Dream College Path LLC, 6200 Village Parkway, STE 200, Dublin, CA 94568, Email: dmca@dreamcollegepath.com. Your notice should include: (a) identification of the copyrighted work claimed to be infringed; (b) identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material; (c) your contact information; (d) a statement that you have a good-faith belief that the use is not authorized; and (e) a statement under penalty of perjury that the information is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
12. Disclaimers
12.1 Service Provided "As Is"
To the maximum extent permitted by law, the Service and Content are provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12.2 No Warranty of Outcomes
We do not warrant or guarantee any outcome, including (without limitation) admissions decisions, scholarship decisions, test score improvements, or academic performance.
12.3 Availability and Technical Issues
We do not warrant that the Service will be uninterrupted, error-free, or secure, or that defects will be corrected. You assume the risk of using information obtained through the Service and are responsible for implementing appropriate safeguards.
13. Limitation of Liability
To the maximum extent permitted by law, Dream College Path and its affiliates, officers, directors, employees, contractors, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages.
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amount you paid to us for the Paid Services giving rise to the claim during the 12 months before the event giving rise to liability, or (b) one hundred U.S. dollars (US $100). Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.
14. Indemnification
You agree to indemnify, defend, and hold harmless Dream College Path and its affiliates, officers, directors, employees, contractors, licensors, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any law or the rights of any third party.
15. Suspension and Termination
15.1 Termination by You
You may stop using the Service at any time. You may be able to delete your Account through the Service or by contacting us. Deleting an Account may not automatically cancel any subscription purchased through an app store; you must cancel through the app store account settings.
15.2 Suspension or Termination by Us
We may suspend or terminate your access to the Service (including your Account), with or without notice, if we reasonably believe you have violated these Terms, pose a risk to the Service or other users, or if required to do so by law. We may also discontinue the Service or any part of it at any time.
15.3 Effect of Termination
Upon termination, your license to use the Service ends. Sections that by their nature should survive termination will survive, including Sections 5 (User Content license to operate the Service), 6 (Intellectual Property), 12–14 (Disclaimers, Limitation of Liability, Indemnification), 18 (Dispute Resolution), and 19 (Miscellaneous).
16. Changes to the Service or These Terms
We may update the Service and these Terms from time to time. If we make material changes, we may provide notice by posting the updated Terms in the Service, updating the "Last Updated" date, or by other reasonable means. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the updated Terms.
17. Governing Law
These Terms and any dispute arising out of or relating to these Terms or the Service will be governed by the laws of the State of California, without regard to conflict of laws principles, except to the extent preempted by U.S. federal law.
18. Dispute Resolution; Arbitration; Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. It may require you to resolve disputes through binding arbitration rather than in court and limits the way you can seek relief.
18.1 Informal Resolution
Before initiating arbitration or a court proceeding, you agree to first contact us at support@dreamcollegepath.com and provide a brief written description of the dispute and your contact information. The parties will attempt in good faith to resolve the dispute informally within 60 days.
18.2 Agreement to Arbitrate
Except for disputes that qualify for small claims court or requests for injunctive or other equitable relief to stop unauthorized use or infringement of intellectual property, you and Dream College Path agree to resolve any dispute arising out of or relating to these Terms or the Service through final and binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, as modified by these Terms.
18.3 No Class Actions
You and Dream College Path agree that disputes will be brought only on an individual basis and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to resolve that party's individual claim(s).
18.4 Arbitration Location and Procedure
The arbitration will be conducted in English. The location of any in-person hearing will be in the county where you reside (or another mutually agreed location), unless the AAA rules require otherwise. If your claim is for $10,000 or less, you may choose whether the arbitration will be conducted solely on the basis of documents, by phone, or by an in-person hearing, consistent with AAA rules.
18.5 Opt-Out
You may opt out of this arbitration agreement by sending written notice within 30 days of first accepting these Terms to: Dream College Path LLC, Attn: Legal – Arbitration Opt-Out, 6200 Village Parkway, STE 200, Dublin, CA 94568, or by email to legal@dreamcollegepath.com. Your notice must include your name, Account email, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other provisions of these Terms.
18.6 Severability
If any part of this Section 18 is found unenforceable, the remainder will remain in effect, except that if the class action waiver is found unenforceable, then the entire arbitration agreement will be null and void.
19. Miscellaneous
19.1 Entire Agreement
These Terms, together with any referenced policies (including the Privacy Policy) and any additional terms you agree to for Paid Services, constitute the entire agreement between you and Dream College Path regarding the Service.
19.2 Assignment
You may not assign or transfer these Terms or your rights and obligations under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets.
19.3 Severability and Waiver
If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of our right to do so later.
19.4 Notices and Contact Information

19.5 Electronic Communications
By using the Service, you consent to receive these Terms and related notices electronically. You agree that electronic communications satisfy any legal requirement that such communications be in writing.
19.6 Force Majeure
We will not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, internet service provider failures, or governmental actions.
19.7 Mobile App Store Terms
If you download the mobile application from Apple's App Store or Google Play (or another third-party app store), you acknowledge that your use of the app is also subject to the app store's terms. To the extent permitted by law, you acknowledge that the app store is not a party to these Terms and has no obligation to provide support for the app, and that Dream College Path, not the app store, is responsible for the Service.
19.8 Export and Sanctions
You may not use the Service if you are located in a jurisdiction that is subject to U.S. embargo, or if you are prohibited from using the Service under applicable sanctions laws. You agree to comply with all applicable export and sanctions laws.
